Digital Millennium Copyright Act
We uphold the rights of intellectual property owners and expect the same in return. In compliance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), copyright owners or their representatives may issue a takedown notice to our designated DMCA Agent. As an internet service provider, we are shielded by the “safe harbor” provisions of the DMCA against claims of infringement. To file a legitimate infringement claim, you must provide us with the following details:
Infringement Notification – Claim
- A signature, either physical or electronic, of the copyright owner or an authorized representative;
- Identification of the copyrighted work alleged to have been infringed;
- Identification of the infringing material, along with sufficient information to locate it. [Please include the URL of the relevant page];
- Contact details of the complaining party, including name, physical address, email address, phone number, and fax number;
- A statement affirming that the use of the material is unauthorized by the copyright owner;
- A statement asserting the accuracy of the provided information, and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.
Under Title 17 USC §512(f), individuals who knowingly misrepresent information in a copyright infringement notification may be subject to civil damages, including legal costs and attorney fees.
All takedown notices should be sent through our Contact page, preferably via email for prompt processing.
Please be aware that we may disclose the identity and details of any copyright infringement claim to the alleged infringer. By submitting a claim, you acknowledge and consent to such disclosure.
Counter Notification – Restoration of Content
If your material has been removed due to a copyright infringement claim, you may submit a counter notification to request its restoration. This notification must be provided in writing to our DMCA Agent and include the following elements as per 17 USC Section 512(g)(3):
- Your signature, physical or electronic;
- Description of the removed material and its original location;
- A statement, under penalty of perjury, that the removal resulted from mistake or misidentification;
- Your name, address, telephone number, and consent to jurisdiction for legal proceedings.
Submit your counter notice through our Contact page, with email being the preferred method.
Repeat Infringer Policy
We have a strict policy regarding repeat copyright infringement. In accordance with DMCA requirements, we maintain a record of DMCA notices and take steps to identify repeat offenders. Accounts found violating our policy will be terminated.
Modifications
We reserve the right to update this policy on handling DMCA claims at any time and for any reason. Please check back regularly for updates.
